Compensation Assessment Scheme

This website contains information for the Compensation Assessment Scheme that has been set up to compensate victims of a data breach that occurred on the website of the Department of Immigration and Border Protection (now named the Department of Home Affairs) (the Data Breach), pursuant to HYYL and Privacy Commissioner [2023] AATA 2961.

Norton Rose Fulbright Australia (NRFA) has been appointed as the administrator of the Compensation Assessment Scheme.

The Data Breach occurred when a spreadsheet was published on the website of the Department of Immigration and Border Protection that contained the personal information of approximately 9,000 persons. Those persons were in immigration or other places of detention. The spreadsheet should not have been published on the website.

The personal information was removed from the Department’s website on 19 February 2014 and from a historical version of the Department’s website on 27 February 2014.

What stage is the Compensation Assessment Scheme up to?

​​To participate in the Compensation Assessment Scheme, you had to provide submissions or evidence to NRFA by 4 PM AEST 10 June 2024.

The available period to provide submissions or evidence has now closed.

If you have contacted NRFA and requested an extension of time, you may provide your submissions or evidence via email to auscas@nortonrosefulbright.com. Responses will only be accepted if you have received an extension of time. All other submissions received after 4 PM AEST 10 June 2024 will not be considered.

NRFA will review the submissions or evidence it has been provided with, including any submissions or evidence previously submitted to the Office of the Australian Information Commissioner (the OAIC).

After this review has been completed, NRFA will contact people with more information about their claim for compensation.
